KOPETSKY HAULING INC., GREENWOOD, IND., AGREES TO PAY $32,616 TO WORKERS FOR FEDERAL WAGE VIOLATIONS
Firm permanently enjoined from future violations
Chicago The U.S. Department of Labor announced today that Kopetsky Hauling Inc., 5585 W. Fairview Rd., Greenwood, Ind., has agreed to pay $32,616.48 for federal overtime pay violations.
An agreed judgment was issued by U.S. District Court Magistrate John Paul Godich, Southern District of Indiana, Indianapolis, under the Fair Labor Standards Act (FLSA). The court ordered the firm to pay back wages of $24,500 to 21 past or present employees. Kopetsky Hauling Inc. and George Kopetsky II, president, were permanently enjoined from future overtime pay and record keeping violations of the FLSA, the federal wage and hour law. The corporation and Kopetsky did not admit any of the violations that allegedly occurred during March 1995 to March 1996.
The court also ordered the firm to pay liquidated damages of $7,250 and interest of $866.48 to employees.
District Director Connie Klipsch of the Wage and Hour Division in Indianapolis said, "The Labor Department will take all necessary actions to prevent future violations and ensure that workers are properly paid."
The Labor Department's Wage and Hour Division enforces the FLSA which sets a federal minimum wage of $5.15 for most workers. The law generally requires overtime pay for hours worked over 40 in a workweek. The FLSA also requires employers to keep accurate time and payroll records.
The legal action followed an investigation by the Wage and Hour District Office, 429 N. Pennsylvania St., Indianapolis, under the supervision of Connie Klipsch, district director.
