Firm agrees to pay $5,613 in back wages UNICCO SERVICE COMPANY, CINCINNATI, OHIO, FINED $31,800 FOR ALLEGED REPEAT OVERTIME PAY VIOLATIONS

CHICAGO — The U.S. Department of Labor has issued a civil money penalty of $31,800 to UNICCO Service Company, 906 Main Street, Cincinnati, Ohio, for alleged repeat overtime pay violations.

An investigation by the Labor Department under the Fair Labor Standards Act found that UNICCO Service Company, a nation-wide janitorial firm based in Auburndale, Mass., did not pay overtime pay to some workers after 40 hours in a week. The firm agreed to pay $5,613 to 53 workers in Cincinnati. The violations occurred during October 1997 through October 1999.

Wage and Hour Division District Director Richard Malloy in Columbus said, "This case exemplifies the Labor Department’s efforts to protect vulnerable low-wage workers and prevent future violations."

The Wage and Hour Division found overtime violations by UNICCO Service Company during investigations conducted in Massachusetts in 1993, 1994, and January of this year.

The firm has appealed the fine. The matter will be referred for a hearing before a Labor Department administrative law judge.

The Labor Department’s Wage and Hour Division enforces the Fair labor Standards Act which sets a federal minimum wage of $5.15 for most workers. The federal law generally requires overtime pay for hours worked over 40 in a workweek. Employers are required to keep accurate time and payroll records.

The investigation was conducted by the Wage and Hour Division, 525 Vine Street, in Cincinnati, under the supervision of Richard Malloy, district director.
