MARYVILLE, VANDALIA AND SILVIS HEALTH CARE FACILITIES PAY $14,710 IN BACK WAGES AND ARE ASSESSED $8,400 IN PENALTIES FOR WAGE VIOLATIONS

Chicago — Springwood Associates, a limited partnership doing business in Maryville, Vandalia, and Silvis, Ill., has paid $14,710 in back wages to 42 present and former employees as a result of violations of the Fair Labor Standards Act (FLSA), which is the federal wage and hour law.

The firm has also been assessed civil money penalties totaling $8,400 for repeated overtime pay violations of the FLSA at the three locations. Elmwood Healthcare Center, located at Rt. 159 and I-70, Maryville, Ill., was assessed a civil money penalty of $4,600. Cherrywood Healthcare, 1500 W. St. Louis Ave., Vandalia, Ill., was assessed $2,600. Aspenwood Healthcare, 1403 9th Ave., Silvis, Ill., was assessed $1,200.

"This is not the first instance of violations by the company," according to Henry Rodriguez, district director of the U.S. Labor Department's Wage and Hour District Office, Springfield. "Civil money penalties such as these serve notice of our intention to ensure that employers comply with the law." During prior investigations, the firm was also found in violation of the FLSA at four locations.

Enforced by the Wage and Hour Division of the Employment Standards Administration (ESA), the FLSA sets a federal minimum wage of $4.25 for most workers and generally requires overtime pay for hours worked over 40 in any workweek. The FLSA also requires employers to keep adequate time and payroll records. ESA is an agency of the U.S. Department of Labor.

In issuing the assessments against Springwood Associates, the Labor Department's Wage and Hour Division alleged time cards were not accurate, employees worked during their meal breaks, and certain non-exempt salaried employees were not paid overtime.

The firm has been given 15 days to file exception to the assessments.

The investigations were conducted by the Wage and Hour District Office, 509 W. Capitol Ave., Springfield, Ill., under the supervision of Henry Rodriguez.
