SCHULZE REST HOME, SCHULZE SHARE-A-HOME TO PAY $49,900 IN BACK WAGES TO AREA WORKERS

Chicago — Schulze Rest Home and Schulze Share-A-Home, Dayton, have been ordered to pay $49,928.07 in back wages for 25 current or former employees owed as a result of violations of the Fair Labor standards Act (FLSA), which is the federal wage and hour law.

The back wages were ordered to be paid with the entry of a judgment in Federal District Court, Cincinnati, which also enjoined the firm from further violations of the minimum wage, overtime pay and recordkeeping provisions of the FLSA.

In a related action, the firms agreed to pay a civil money penalty of $7,000 as a result of the FLSA violations.

Enforced by the Wage and Hour Division of the Employment Standards Administration (ESA), U.S. Labor Department, the FLSA sets a federal minimum wage for most workers and generally requires overtime pay for hours worked over 40 in any workweek.

The FLSA also requires employers to keep adequate time and payroll records. ESA is an agency of the U.S. Department of Labor.

Wage and Hour Regional Administrator William Van Zanen, Chicago, said that the case exemplifies the Labor Department's efforts to protect vulnerable populations such as low wage workers and minors, and to deter violations with significant penalties.

The legal action resolves a complaint which was filed following an investigation by the Wage and Hour District Office, 525 Vine St., Cincinnati, under the supervision of Glenn A. Fierst, district director.

Civil Action No. C-1-94-672
