DETROIT AREA RESTAURANT FINED $8,000 FOR ALLEGED CHILD LABOR VIOLATIONS
Chicago Ram's Horn Restaurant, 13110 Telegraph Road, Taylor, Mich., and Mark Kaiser, owner of the restaurant, have been assessed a civil money penalty of $8,100 for alleged violations of federal child labor laws.
Investigation of the restaurant by the Labor Department's Wage Hour Division led to the allegations that 12 children, ages 14 and 15, were employed later at night and more hours per day than allowed under the Fair Labor Standards Act (FLSA). A previous investigation of the restaurant disclosed similar child labor violations in 1987. Under the FLSA 14 and 15 year old children may work outside of school hours, but no later than 7:00 p.m. (9:00 p.m. from June 1 through Labor Day). They may not work more than three hours on school days nor more than 18 hours in school weeks. In addition, they may not work more than eight hours on non-school days, or more than forty hours during non-school weeks.
The civil money penalty was assessed following an investigation supervised by Wage and Hour District Director Daniel H. Ocharzak.
The company has 15 days under the regulations to file an exception to the civil money penalty. The matter is then referred for a hearing before an administrative law judge.
Ocharzak said this case exemplifies the Labor Department's continuing efforts to protect vulnerable populations such as working children. "The Labor Department will take strong steps to protect vulnerable young workers," he said. "Young children should have a valuable work experience that is safe and does not interfere with their education."
