BLOOMINGTON SUBWAY ASSESSED $6,000 PENALTY FOR ALLEGED CHILD LABOR VIOLATIONS

Chicago — Davann Inc., doing business as Subway, 10700 Bloomington Ferry Rd., Bloomington, Minn., has been assessed $6,000 in civil money penalties for alleged child labor violations of the Fair Labor Standards Act (FLSA), the U.S. Department of Labor announced today.

Following an investigation, the department's Wage and Hour Division alleged that nine minors, ages 14 and 15, worked in violation of the hours and times standards, working as late as 9:30 p.m. and as many as six hours on a school day. In addition, three of the minors allegedly were employed baking bread, a violation of the employment standards for children under 16 years of age.

The child labor regulations of the FLSA restrict the hours persons under 16 years of age may work. They may not work past 7:00 p.m. (9:00 p.m. June 1 through Labor Day). They may not work more than three hours on school days and eight hours on nonschool days nor more than 18 hours in school weeks and 40 hours in nonschool weeks.

The regulations also restrict the occupations or jobs which 14- and 15-year-olds may perform and prohbit all minors under 18 from certain jobs due to the hazards inherent in the work.

The investigation, covering the period May 1994 through May 1996, was conducted by the Wage and Hour District Office, 220 S. Second St., Room 106, Minneapolis, under the supervision of Denise Scharlemann, district director.
