CLINTON HILL COUNTRY CLUB, INC., BELLEVILLE, ILL., ASSESSED $4,650 PENALTY FOR ALLEGED CHILD LABOR VIOLATIONS

Chicago — Clinton Hill Country Club, Inc., Belleville, Ill., has been assessed $4,650 in civil money penalties for alleged child labor violations of the Fair Labor Standards Act (FLSA), the federal wage and hour law.

The U.S. Department of Labor's Wage and Hour Division alleged that two employees, ages 13 and 14, worked more hours or later than allowed by federal child labor laws. The department also alleged that both children operated a power washer and drove golf carts, occupations prohibited to minors under 16. In addition, the 13-year-old was under the minimum age for employment, which is 14.

Wage and Hour District Director Henry Rodriguez, Springfield, said that the case exemplifies the Labor Department's efforts to protect vulnerable populations such as children, deterring violations with significant penalties and getting results swiftly and efficiently.

The firm has 15 working days to file an exception letter with the department detailing why the alleged violations did not occur. The matter then is referred to the Chief Administrative Law Judge for a formal hearing.

The child labor provisions of the FLSA detail the hours children under 16 may work. They may not work later than 7:00 p.m. (9:00 p.m. June 1 through Labor Day). They may work no more than three hours on school days and eight hours on nonschool days and no more than 18 hours during school weeks and 40 hours during nonschool weeks. The law also restricts occupations which persons under 16 may perform due to the hazards inherent in the work.

The investigation was conducted by the Wage and Hour District Office, 509 W. Capitol, Springfield, under the supervision of Rodriguez.
