U.S. LABOR DEPARTMENT FILES COMPLAINT AGAINST 24 HOUR NURSING SERVICE, SPRINGFIELD, ILL., ALLEGING FEDERAL WAGE-HOUR VIOLATIONS

Chicago — The U.S. Department of Labor has filed a complaint against 24 Hour Nursing Service, 2240 and 2244 North Third, Springfield, Ill., alleging violations of the overtime pay, record keeping and discrimination provisions of the Fair Labor Standards Act (FLSA).

The department alleged in a complaint filed in U.S. District Court for the Central District of Illinois, Springfield, that the firm failed to pay time and one-half pay for work hours over 40 in a week. The violations allegedly occurred since January 1994. The complaint also alleged that the firm’s records did not adequately show total hours worked each workday and workweek with respect to many employees.

The department asked the court to enjoin the firm from future violations of the FLSA. The Labor Department also alleged that the residential care facility discriminated against and discharged two employees who asserted their rights under the FLSA.

The department is seeking reinstatement, back pay, interest and other appropriate compensation found by the court to be due to these employees. The Labor Department is seeking back wages for seven employees and liquidated damages or interest. Liquidated damages under the FLSA are an amount equal to the unpaid compensation.

Wage and Hour District Director Henry Rodriguez, Springfield, said that the case exemplifies the Labor Department's efforts to protect the rights of employees and ensure that all employees are properly paid.

The Wage and Hour Division of the Employment Standards Administration (ESA), U.S. Labor Department, enforces the FLSA. The law sets a federal minimum wage of $4.75 for most workers and generally requires overtime pay for hours worked over 40 in any workweek.

The FLSA also requires employers to keep adequate time and payroll records and sets standards for the employment of minors.

Legal action followed an investigation by the Wage and Hour District Office, 509 W. Capitol Ave., Springfield, Ill., under the supervision of Henry Rodriguez, district director.
