MANISTEE CONTRACTOR INDICTED FOR SUBMITTING FALSE PAYROLL FORMS TO HIDE UNDERPAYMENT OF WORKERS' WAGES

Chicago — Robert H. S. Mielhke, Jr., a Manistee, Mich., contractor has been indicted by a federal grant jury for seven counts of making false statements to the federal government regarding wages paid to workers on various federally funded projects in Michigan.

Miehlke's firm, Miehlke's Seeding and Mulching and Warehouse of Manistee, Michigan, received contracts from the Michigan Department of Transportation to perform work in Lakeview, Boyne City, East Jordan, Harbor Springs, Scottville, Lapeer and Naubinway among other locations between 1991 and 1993.

The indictment alleges that Mielhke submitted falsified federal wage-and-hour forms which indicated that Mielhke paid workers more than ten dollars higher than the workers actually received, and falsely stated that an employee did not work overtime. The amounts falsely reported as being paid are those required by the federal government under the Davis-Bacon Act and related laws.

The investigation into Miehlke's firm was conducted by the Wage and Hour Division of the U.S. Department of Labor. The case is being prosecuted by Assistant U.S. Attorney Thomas O. Martin.

Each of the seven counts in the indictment carries a maximum penalty of five years imprisonment and a $250,000 fine. The charges in an indictment are merely an accusation and the defendant is presumed innocent until and unless proven guilty in a court of law.
