MILK PAIL FAMILY RESTAURANT PAYS $3,921 IN UNPAID BACK WAGES TO RESOLVE ALLEGED MINIMUM WAGE AND OVERTIME VIOLATIONS
Chicago Boyles Restaurants, Inc., doing business as Milk Pail Family Restaurant, 28991 Lorain Road, North Olmsted, Ohio, has agreed to pay $3,921 in unpaid back wages for alleged minimum wage and overtime violations of the Fair Labor Standards Act (FLSA), the federal wage and hour law.
In a Stipulation and Judgment filed in U.S. District Court, Northern District of Ohio, Eastern Division, the company agreed to pay the back wages without admitting the alleged violations.
Back wages were found due to 21 current and former employees for alleged violations of the minimum wage during the period August 1994 through December 1994. In addition, three of the employees were due back wages for alleged overtime compensation violations. Amounts due to individuals range from $20 to $1,471.
The FLSA sets the federal minimum wage at $4.25 per hour for most employees. Also, the law generally requires overtime compensation at one and one-half the regular rate of pay for hours worked over 40 in a week.
The legal action follows an investigation by the U.S. Labor Department's Wage and Hour District Office, 1240 E. 9th Street, Suite 817, Cleveland, under the supervision of Barry Haber, district director.
