GRANDMA'S BAKERY, WHITE BEAR LAKE, MINN.., ASSESSED $15,850 PENALTY FOR ALLEGED CHILD LABOR VIOLATIONS

Chicago — Grandma's Bakery, Inc., 1765 Buerkle Road, White Bear Lake, Minn., and its president, John M. Lupo III, have been assessed $15,850 in civil money penalties for alleged child labor violations of the Fair Labor Standards Act (FLSA), the federal wage and hour law.

The U.S. Department of Labor's Wage and Hour Division alleged that the company employed a total of nine minors in violation of child labor regulations. Five 15-year-olds and four 16- and 17-year olds operated, cleaned and disassembled vertical dough mixers, occupations prohibited to persons under 18 years of age.

Two of the 15-year-olds allegedly were employed cooking, a violation of employment standards for persons under 16 years of age. In addition, the five 15-year-olds allegedly worked in violation of the hour and time standards, working as many as 5 hours on school days and as late as 9:00 p.m. between Labor Day and June 1.

Federal child labor laws prohibit persons under 18 years of age from performing certain occupations or jobs due to hazards inherent in the work. The laws further restrict the occupations which children under 16 may perform.

The child labor regulations also restrict the hours children under 16 may work. They may not work past 7:00 p.m. (9:00 p.m. June 1 through Labor Day). They may not work more than three hours on school days and eight hours on nonschool days nor may they work more than 18 hours during school weeks and 40 hours during nonschool weeks.

The firm has paid $1,929 in overtime back wages to 13 employees. The FLSA requires overtime compensation of one and one-half the regular rate of pay be paid for all hours over 40 worked in a week.

An investigation covering the period January 1994 through January 1996 was conducted by the Wage and Hour District Office, 220 S. Second Street, Room 106, Minneapolis, under the supervision of Denise Scharlemann, district director.
