ZEELAND FIRM ORDERED TO PAY $105,178 IN UNPAID FRINGE BENEFITS FOR VIOLATIONS OF DAVIS-BACON ACT
Chicago Ron Meyer & Associates Excavating, Inc., Zeeland, Mich., has been ordered to pay $105,178 in unpaid fringe benefits withheld in violation of the Davis-Bacon Act, the U.S. Department of Labor announced today.
Administrative Law Judge J. Michael O'Neill, Cincinnati, Ohio, ruled that the firm failed to pay fringe benefits to 42 employees as required by the Davis-Bacon Act.
The firm contracted with the Board of County Road Commissioners, Ottawa County, Mich., to excavate and lay sewer pipes in Drenthe and Vriesland, Mich. The project began in July 1991 and finished in September 1992.
The contract was funded by the Environmental Protection Agency under the Federal Water Pollution Control Act and was thereby subject to the Davis-Bacon Act. The Davis-Bacon Act requires contractors to pay employees working on a contract the prevailing wage rate including fringe benefits as established by the Labor Department.
The legal action follows an investigation by the Labor Department's Wage and Hour District Office, 2920 Fuller Avenue N.E., Suite 100, Grand Rapids, under the supervision of Daniel H. Ocharzak.
