ROGERS, Ark. -- The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) has cited Jimmie Bond Construction in Rogers, Ark., and proposed penalties totaling $49,500 for failing to protect workers on scaffolds from falls. OSHA cited the company with five serious and seven repeat violations following an investigation that began April 13 as part of OSHA's Local Emphasis Program on fall hazards in the construction industry. "An OSHA inspector driving by the worksite saw workers without protection for falls from scaffold platforms that did not meet OSHA standards," said Paul J. Hansen, Little Rock area director. Among the serious citations were improper use of a scaffold, including extending the scaffold platform more than 12 inches past its support and failing to properly brace the cantilevered scaffold platforms. The employer also failed to develop, implement and maintain a written hazard communications program. A serious citation is issued when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known. The repeat violations for which the company was cited included failing to: clear excess debris off of the scaffold; fully plank the scaffold; provide proper means of scaffold access; protect workers on scaffolds greater than 10 feet off the ground, and provide protection from falling tools and other materials. A violation is designated as repeat when a similar citation for the same hazard was issued in the previous three years. Jimmie Bond Construction, a masonry contractor headquartered in Natural Dam, Ark., employs a total of about 40 workers, four of whom were working at the site. The company has 15 working days from receipt of the citations to comply, request an informal conference with the OSHA Little Rock area director or contest the citations and proposed penalties before the independent Occupational Safety and Health Review Commission.
