INDICTMENT

The Grand Jury Charges:

  1. At all material times hereto Daniel Van Becelaere was the Secretary-Treasurer of United Transportation Union, AFL-CIO, Local 763.
  2. At all material times hereto, Local 763 of the United Transportation Union, AFL-CIO was a labor organization as defined by the laws of the United States.

COUNT ONE

  1. The Grand Jury incorporates by reference paragraphs 1 and 2.
  2. Beginning on or about March 17, 2000, and continuing through December 29, 2000, in the District of Kansas, the defendant,

DANIEL VAN BECELAERE,

did embezzle, unlawfully and willfully abstract or convert to his own use, or the use of another, the moneys, funds, property or assets of a labor organization, of which he was an officer, to wit: during 2000, the defendant, while serving as the Secretary-Treasurer of Local 763 of the United Transportation Union, AFL-CIO, did embezzle or unlawfully and willfully convert to his own use, approximately $10,274.24 of the Union's moneys and funds.

In violation of Title 29, United States Code, Section 501(c).

COUNT TWO

  1. The Grand Jury incorporates paragraphs 1 and 2.
  2. Beginning on or about January 3, 2001, and continuing through December 20, 2001, in the District of Kansas,

DANIEL VAN BECELAERE,

did embezzle, unlawfully and willfully abstract or convert to his own use, or the use of another, the moneys, funds, property, or assets of a labor organization, of which he was an officer, to wit; during 2001, the defendant, while serving as the Secretary-Treasurer of Local 763 of the United Transportation Union, AFL-CIO, did embezzle or unlawfully and willfully convert to his own use, approximately $22,285.00 of the Union's moneys and funds.

In violation of Title 29, United States Code, Section 501(c).

COUNT THREE

  1. The Grand Jury incorporates paragraphs 1 and 2.
  2. Beginning on or about January l, 2002, and continuing through April 23, 2002, in the District of Kansas, the defendant,

DANIEL VAN BECELAERE,

did embezzle, unlawfully and willfully abstract or convert to his own use, or the use of another, the moneys, funds property or assets of a labor organization, of which he was an officer, to wit; during 2002, the defendant, while serving as the Secretary-Treasurer of Local 763 of the United States Transportation, AFL-CIO, did embezzle or convert to his own use, approximately $3,610.60 of the Union's moneys and funds.

In violation of Title 29, United States Code, Section 501(c).

A TRUE BILL.
