Pueblo Builder Pays Nearly $124,000 in Overtime to 52 Employees Following U.S. Department of Labor Investigation

PUEBLO, Colo. -- Discount Max Construction, a residential and commercial builder in Pueblo, has paid $123,927 in back overtime wages to 52 low-wage workers following an investigation by the U.S. Department of Labor’s Wage and Hour Division.

“This investigation reflects the department’s commitment to protect the overtime rights of workers and ensure they receive the full wages they have earned,” said Alex Salaiz, Wage and Hour Division district director in Denver.

The employer violated the Fair Labor Standards Act (FLSA) by failing to properly pay overtime to employees who worked an average of 61 hours per week. It was the first such investigation of the firm.

Discount Max Construction cooperated fully with the investigation and agreed to future compliance. Back wages have been paid in full.

Enforced by the Wage and Hour Division, the FLSA requires that employers pay covered workers at least the federal minimum wage for all hours worked and time and one-half their regular rate of pay for hours worked more than 40 in a single workweek. Employers also must maintain adequate and accurate records of employees’ wages, hours and other conditions of employment.
