Canyon Pearl Inc. and Hunan Pearl Inc., in Portland, Ore., Agree To Pay 19 Workers a Total of $150,000

PORTLAND, Ore. -- Nineteen employees of two local restaurants operated by Hunan Pearl Inc. and Canyon Pearl Inc. will receive a total of $150,000 owed to them in back pay and interest under a federal consent judgment, the U.S. Department of Labor’s Wage and Hour Division announced today.

The settlement includes an agreement by the companies to correct violations of the minimum wage, overtime pay and recordkeeping provisions of the federal Fair Labor Standards Act (FLSA.) Individuals Michael Yung-Chin-Shu, Winnie Sau-Man Shu, Silvia Fung, Su Fung, Sam Pieh, Miles Tai-Fu Shu and Jason Kar-Sheng Liang also agreed to the entry of the consent judgment, which prohibits them from future violations of the FLSA and orders the back wage payments.

The complaint was filed and the consent findings were signed in the U.S. District Court in Portland.

According to Bonny Crosby, assistant district director for the department’s Wage Hour Division in Portland, the workers were cooks and dishwashers at two Chinese restaurants in the Portland area who were not paid minimum wage or overtime pay for hours more than 40 per week.

The Fair Labor Standards Act requires that employers pay covered workers at least the federal minimum wage of $5.15 per hour and one-and one half times their regular rates of pay for all hours worked more than 40 in a single workweek, unless otherwise exempt. Employers must also maintain accurate records of employees’ wages, hours and other conditions of employment.

For more information about the FLSA, call the Wage and Hour Division office in Portland at (503) 326-5952 or the U.S. Department of Labor’s toll-free help line at (866) 4US-WAGE (487-9243). Information is also available at www.wagehour.dol.gov.
