Starplex Corporation Ordered to Pay $45,000 in Back Wages for Overtime Violations

PORTLAND, Ore. -- Starplex Corporation, Portland, and company owner and president James DeLoretto have been ordered to pay 214 employees a total of $45,000 in unpaid overtime compensation, the U.S. Labor Department announced today. The consent judgment was filed here in the U.S. District Court for the District of Oregon.

"This case reflects the Department of Labor's commitment to protecting overtime rights and ensuring that workers receive the wages they have earned," said Bonny Crosby, assistant district director for the Portland Office of the Wage and Hour Division.

The agency’s investigation, covering the period from Dec. 18, 2000, to Dec. 18, 2002, discovered that the employer violated the overtime provisions of the federal Fair Labor Standards Act (FLSA). The company failed to pay employees at a rate of one and half times the regular rate of pay for hours worked over 40 in one workweek.

Starplex is engaged in crowd management, security and traffic control for various events such as festivals, concerts and fairs throughout Oregon, Washington, Montana and Alaska.

The Wage and Hour Division recovered nearly $200 million in back wages in fiscal year (FY) 2004 for more than 288,000 workers. Average days to resolve a complaint decreased during that time from 108 to 92 days.

For more information about the FLSA, call the Seattle Wage and Hour Office at 206-398-8039 or the department’s toll-free help line at 1-866-4USWAGE (1-866-487-9243). Information is also available at www.wagehour.dol.gov.
