U.S. Labor Department Sues Las Vegas-Based Construction Company to Recover Back Wages for 250 Nevada Workers

SAN FRANCISCO -- The U. S. Department of Labor has filed a complaint in U.S. District Court in Nevada against Las Vegas-based Pacific Stucco, Inc. seeking payment of back wages, liquidated damages and prejudgment interest for approximately 250 current and former employees.

An investigation conducted by the department's Wage and Hour Division found that latherers, who worked as many as 50 hours a week, did not receive overtime pay and sometimes earned less than minimum wage. Pacific Stucco also failed to properly record the hours of work for these employees, who were paid on a piece rate basis. The Department had found similar problems in two prior investigations of the firm.

The Fair Labor Standards Act (FLSA) requires that covered employees be paid at least the federal minimum wage and receive overtime at one-and-one-half times their regular rate of pay for hours worked over 40 per week.

The most recent investigation covered work performed over a two-year period ending in May 2003.

The Wage and Hour Division recovered more than $212 million in back wages in fiscal year 2003 - a 21 percent increase over the previous year.
