East Bay Pool Company Will Pay $200,000 in Back Wages, Penalties

Federal Judgment Will Benefit More Than 100 Employees

SAN FRANCISCO -- An East Bay company that builds and repairs residential cement pools will pay $201,355 in back wages, including interest, to settle federal charges that it violated the overtime provisions of the Fair Labor Standards Act (FLSA).

Diablo Pool Specialties, Inc., of Livermore, CA., and its president, Alan K. Salo, were named in a federal complaint following an investigation by the Labor Department's Wage and Hour Division.

Under the terms of the consent judgment entered in U.S. District Court in San Francisco on May 6, the company will pay a total of $202,355.36 in overtime and interest to 107 employees. By signing the consent judgment, the company and its officers agree to adhere to the FLSA in the future.

The investigation, conducted by the San Jose Wage and Hour office, revealed that the company did not compensate workers at the higher pay for overtime work during the investigation period covering May 1998 through November 2001.

The Fair Labor Standards Act requires that employees receive at least $5.15 per hour and not less than one and one-half times their regular rate of pay for their work in excess of 40 hours in a workweek.

"We take very seriously the responsibility of protecting workers, especially those in lower wage jobs, by ensuring that they receive overtime as federal law provides," said Susana Rincon, the Wage and Hour Division's assistant district director in San Jose.
