McCutchen Receives Senate Confirmation Illinois Native To Lead
Wage and Hour Division
WASHINGTONU.S. Secretary of Labor Elaine L. Chao announced that
the U.S. Senate has confirmed Tammy D. McCutchen as the new Wage and Hour
Administrator for the Employment Standards Administration.
Tammys role in creating a 21st Century workforce
is to shape common sense rules that protect workers while giving them the
flexibility they need, said Chao.
Prior to joining the U.S. Department of Labor, McCutchen was senior
counsel for Hershey Foods Corp., where she provided counsel on labor and
employment matters involving Hershey's 15,000 employees at corporate offices
and 22 manufacturing plants in the United States, Canada and Mexico. In her
capacity she dealt with laws affecting American workers such as the Americans
With Disabilities Act, the Fair Labor Standards Act and the Family and Medical
Leave Act.
McCutchen managed the implementation of Hershey Foods Corporation's
affirmative action plans, assisted Hershey's Diversity Counsel and conducted
training for managers on recognizing and responding to discriminatory
harassment. She has also advised the corporation on collective bargaining and
labor arbitration issues.
Prior to working at Hershey Foods, McCutchen was an associate attorney
at the Chicago law firms of Matkov, Salzman, Madoff & Gunn and Skadden,
Arps, Slate, Meagher & Flom. She was born in Cambridge, Ill., and graduated
summa cum laude from Western Illinois University with a B.A. in English
literature. She earned her law degree from the Northwestern University School
of Law, where she graduated cum laude and received the Order of the Coif.
The Wage and Hour Division enforces, among other things, the Federal
minimum wage, the overtime pay, record keeping, and child labor requirements of
the Fair Labor Standards Act. Additionally, the division administers and
enforces the prevailing wage requirements of the Davis Bacon Act, the Service
Contract Act and other statutes applicable to Federal contracts for
construction and for the provision of goods and services.
