U.S. Labor Department secures more than $100,000 in back wages for employees of two Brooklyn, N.Y., medical clinics

NEW YORK -- Following an investigation by the U.S. Department of Labor, two corporations with employees at two New York City medical clinics have agreed to pay 50 workers a total of $100,331 in overtime back wages due under the federal Fair Labor Standards Act (FLSA).

The investigation by the department’s Wage and Hour Division found that clerical and medical assistants as well as nurses employed by Janlian Medical Group LLC and one janitor employed by Fuzihan LLC at two Brooklyn, N.Y., locations were paid a straight salary for all hours worked and not paid overtime wages as required by the FLSA.

The FLSA requires that employees be paid at least the federal minimum wage and time and one-half their regular rates of pay for hours worked beyond 40 per week. The law also requires that employers maintain accurate records of employees’ wages, hours and other conditions of employment.

The two Janlian Medical Group clinics are located at 833 58th St. and 1508 Avenue U. Janlian pays the medical employees and Fuzihan pays the janitorial employees who work at both locations.

After being informed of the investigation’s findings, the owners and officers of both corporations agreed to pay employees the back wages due and pledged full future compliance with the requirements of the FLSA, noted Philip Jacobson, director of the Wage and Hour Division’s district office in New York City.

“We are always pleased,” said Jacobson, “when we present our findings to employers and are met with cooperation rather than resistance. It is the goal of the Wage and Hour Division and should be the goal of all employers to make sure that workers are paid properly for all the hours they work.”

The Wage and Hour Division concluded 31,987 compliance actions and recovered more than $171 million in back wages for more than 246,000 employees in fiscal year 2006. Back-wage collections in fiscal year 2006 represent a 30 percent increase over back wages collected in fiscal year 2001. The number of workers receiving back wages has increased by 14 percent since fiscal 2001.
