U.S. Labor Department Files Suit to Recover $136,000 in Back Wages for Medical Office Workers

ST. LOUIS, Mo. -- The U.S. Department of Labor has filed a lawsuit against St. Louis Internal Medicine Inc. and Mea Wilkinson for alleged minimum wage, overtime, and record keeping violations of the Fair Labor Standards Act (FLSA). The lawsuit seeks to recover $136,278 in back wages due 20 employees of the company.

The complaint was filed in U.S. District Court for the Eastern District of Missouri, Eastern Division in Saint Louis, following an investigation by the department’s Wage and Hour Division (WHD). St. Louis Internal Medicine Inc. is an outpatient medical care facility located at 12700 S. Fork Road. The investigation covered the period Jan. 1, 2003 to Oct. 2, 2005.

“When workers are not paid appropriately under the law, we will act to recover their wages for them,” said Enrique Rodriquez, district director of the Wage and Hour Division in St. Louis. He added that “inaccurate recordkeeping of all hours worked contributed to the employer’s back wage liability.”

The Wage and Hour Division enforces the FLSA, which requires that covered employees be paid at least the federal minimum wage of $5.15 per hour and time and one-half their regular rate of pay for hours worked in excess of 40 hours in any workweek. The law also requires employers to maintain accurate and adequate time and payroll records.
