Omaha Nursing Home Pays $29,000 in Back WagesOMAHA, Neb. -- Maple Crest Care Center paid $29,418 in back wages to 11 employees following a U.S. Department of Labor investigation that found violations of the overtime provisions of the Fair Labor Standards Act (FLSA). The investigation was conducted by the department’s Wage and Hour Division and covered the period February 2004 through February 2006. According to Percella Maupins, Wage and Hour district director for territory covering Omaha, “Meal periods were deducted from the total hours worked by the 11 employees although they were not relieved from duty.” The violations involved RNs, LPNs, clinical managers and a dietary aide of the nursing home located at 2824 N. 66th Ave. According to Maupins, the facility is committed to making future changes in the procedures for meal breaks and to closely monitoring the system in the interim until those changes have been developed and implemented. “This investigation was targeted under the agency’s WRAP (Workers Require Accurate Pay) initiative. The company has had previous investigations but no previous violations,” Maupins said. The Wage and Hour Division of the U.S. Department of Labor enforces the Fair Labor Standards Act (FLSA), including its overtime pay provisions. The FLSA requires employees to be paid the federal minimum wage for all hours worked and time and one-half the regular rate of pay for hours worked over 40 in a week unless the employee is exempt from overtime pay. Employers must also maintain accurate time and payroll records.
