U.S. Department of Labor Files Complaint Against Kansas City Security Firm to Recover $28,000 in Back Wages

KANSAS CITY, Mo. --

The U.S. Department of Labor has filed a legal action against Miller Safety and Security Inc., a Kansas City, Kansas, security guard firm, for ongoing alleged violations of the overtime and recordkeeping provisions of the Fair Labor Standards Act (FLSA). The court petition was filed to recover $27,932.72 on behalf of 14 workers employed at the firm.

The department’s Wage and Hour Division conducted an investigation covering the period from January 2003 to January 2005. The 14 employees worked as security guards and were not paid the additional half time due on hours worked over 40 per week as required by the FLSA. Additionally, the investigation determined the business did not keep records in accordance with the requirements of the Act.

The Fair Labor Standards Act requires employers to pay covered employees the federal minimum wage for all hours worked and time and one-half the regular rate of pay for hours worked over 40 in a week unless the employee is exempt from overtime pay. Employers must also maintain accurate time and payroll records.

The Wage and Hour Division recovered nearly $200 million in back wages in fiscal year 2004 for more than 288,000 workers. Average days to resolve a complaint during that time decreased from 108 to 92 days.
