U.S. Labor Department Recovers Over Half Million Dollars in Back Wages for Area WorkersDunkin Donut/Baskin Robbins Franchise Operator Will Pay 213 WorkersINDIANAPOLIS, Ind. -- “We are committed to ensuring that workers are paid all the wages they have earned,” said Secretary of Labor Elaine L. Chao. “I am pleased that we have succeeded in recovering the overtime wages these workers were due.” Workers were due back wages as a result of overtime pay violations of the Fair Labor Standards Act -- the federal minimum wage and overtime pay law. The owner of the franchises were paying straight- time wages for all hours worked by employees engaged in baking, frying, food preparation and customer service. Once notified of the violations, the employer immediately made policy changes and agreed to pay the back wages in full. The FLSA requires covered employees to be paid the minimum wage for all hours worked and time and one-half their regular rate of pay for hours worked over 40 per week. Employers must also maintain accurate time and payroll records. The Wage and Hour Division recovered nearly $200 million in back wages in fiscal year 2004 for more than 288,000 workers.
