MILWAUKEE, Wis. --

Milwaukee-based Marking Services Inc. has paid $49,145.24 in back wages to 20 employees following a U.S. Department of Labor investigation that found violations of the overtime provisions of the Fair Labor Standards Act (FLSA).

“The Labor Department is committed to ensuring that workers, especially low-wage workers, are paid all the wages due them under the law,” said Jose L. Medina, district director for the Wage and Hour Division in Minneapolis, Minn.

An investigation by the Labor Department’s Wage and Hour Division determined that between March 2004 to March 2006, engineers, installers and foremen employed by Marking Services were not paid the additional half-time required for hours worked more than 40 in a single workweek. The workers were paid on a salary basis, but did not meet exemption requirements of the FLSA, and so were entitled to one and one-half time their regular hourly rate for overtime hours.

The FLSA requires payment of the minimum wage and of overtime at time and one-half an employee’s regular rate of pay for all hours worked in excess of 40 per week. The FLSA also contains record keeping requirements and youth employment standards.
