Mukwonago, Wis., Business Pays Over $50,000 In Back Overtime Wages

MADISON, Wis. --

Marathon Systems Inc., a commercial cleaning and floor restoration business in Mukwonago, Wis., has paid 176 employees $50,854 in unpaid overtime wages following an investigation by the U.S. Department of Labor.

The investigation by the Labor Department’s Wage and Hour Division found violations of the overtime pay provisions of the Fair Labor Standards Act (FLSA) during a two-year period beginning in October 2003. The violations involved workers employed to clean and restore grocery store flooring who did not receive overtime compensation for hours worked over 40 in a single workweek.

“The Department of Labor is committed to ensuring that workers are paid in accordance with the law and for all hours worked,” said Michelle Lenkaitis, assistant district director of the Wage and Hour office in Madison, Wis.

The FLSA requires payment of the minimum wage and of overtime at time and one-half an employee’s regular rate of pay for all hours worked in excess of 40 per week. The FLSA also contains record keeping requirements and youth employment standards.
