Standard Chlorine of Delaware, Inc., No. 98-268-RRM (D. Del.) has been lodged on March 26, 1999, with the United States District Court for the District of Delaware. The consent decree resolves the claims of the United States pursuant to Section 113(b)(2) of the CAA, 42 U.S.C. 7413(b)(2), for civil penalties and injunctive relief, based on alleged violations of regulatory requirements for leak detection and repair of equipment used in the manufacture of chlorine products, and leak repair requirements for industrial refrigeration equipment. The consent decree provides that the defendant shall pay $349,000 in civil penalties. Because all the violations pleaded in the Complaint have been remedied, and the Defendant has sold the facility where the violations occurred to a non-party to this action, no injunctive relief is requested in the consent decree. The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, comments relating to the consent decree.
