Blue Sky, Inc., et al., (Civil Action No. 97-Z-2153), was lodged with the United States District Court for the District of Colorado on October 6, 1999. The proposed Consent Judgment concerns alleged violations of sections 301(a) and 404 of the Clean Water Act, 33 U.S.C. 1311(a) & 1344, resulting from the unauthorized filling of approximately nine acres of wetlands adjacent to the Rio Grande River near Alamosa, Colorado. The proposed Consent Judgment would provide for the payment of a $65,000.00 civil penalty within thirty (30) days of entry of judgment and the restoration and/or creation of 9.5 acres of wetlands at the site. The required restoration is to consist of, among other things, restoration of 3.5 acres of wetland that existed on the southern portion of the Blue Sky property prior to 1996, and creation of an additional 6.0 acres of wetland in the southern portion of the property to mitigate for the loss of wetlands in the northern half of the property. The United States Department of Justice will receive written comments relating to the proposed Consent Judgment for a period of thirty (30) days from the date of publication of this notice.
