Notice is hereby given that on May 27, 1999, a proposed Consent Decree in United States of America et al. v. Braselman Corporation, et al., Civil Action No. 96-0862 (consolidated with No. 96-0872) was lodged in the United States District Court for the Eastern District of Louisiana. The United States and the State of Louisiana filed these actions under section 107 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, 42 U.S.C. 9607, as amended (``CERCLA'') for reimbursement of response costs incurred and to be incurred by the United States for response actions related to the release or threatened release of hazardous substances at the Bayou Bonfouca Superfund Site (``Site'') in the City of Slidell, Louisiana. Under the proposed Consent Decree, the Alabama Great Southern Railroad Company (``Alabama Great Southern'') has agreed to pay the U.S. EPA Hazardous Substance Superfund $11,700,000 in reimbursement of past and potential future response costs at the Site. The United States entered into a prior Consent Decree with Kerr-McGee Chemical Corporation and Kerr-McGee Corporation in which the those defendants agreed to pay $20,000,000 to resolve their liability at the Site. The United States also entered into a previous Consent Decree with Fleming American Investment Trust, Ltd. under which that defendant paid $3,600,000 to resolve its responsibility at the Site. The United States incurred approximately $125,000,000 in cleaning up the Site. The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, comments relating to the proposed Consent Decree.
