Ray McCune et al., Civ. Action No. 2:97CV 0860B was lodged in the United States District Court for the District of Utah on May 11, 1999. The proposed decree settles the United States' Complaint against Ray R. McCune under sections 104, 107 and 113(g)(2) of the Comprehensive Environmental Response, Compensation and Liability Act (``CERCLA''), 42 U.S.C. 9604, 9607, and 9613(g)(2), for reimbursement of costs incurred by the United States in response to the release or threat of release of hazardous substances from the Reclaim Barrel Company Site located at 8487 South Redwood Road, West Jordan, Salt Lake County, Utah (``the Site''). The proposed decree provides for recovery of $10,000.00 in response costs based on Mr. McCune's limited financial ability to fully reimburse the United States for response costs. The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, written comments relating to the proposed Consent Decrees. Comments should be addressed to the Assistant Attorney General for the Environment and Natural Resources Division, Department of Justice, Washington, DC 20530, and should refer to United States v. Ray McCune et al., Civ. Action No. 2:97CV 0860B, DOJ # 90-11-2-1270.
