[[Page 60018]] ACTION: Establishment of open hours for the Reading Island Recreation Site in Shasta County, California. ----------------------------------------------------------------------- SUMMARY: The BLM is prohibiting persons from occupying the Reading Island Recreation Site between 11:00 p.m. and 5:00 a.m. (Pacific Standard Time) without written authorization from a BLM authorized officer. SUPPLEMENTARY INFORMATION: Reading Island is a 40 acre recreation site within Shasta County, California that is adjacent to a residential area. Although most public use at the site is lawful and orderly, night time vandalism, littering and drug use has been a problem. The night time activity deters lawful public use, damages natural resources, and creates a public nuisance. The BLM can reduce this type of unlawful activity and enhance the setting for valid recreation use by requiring a permit for night time occupation of the premises and/or overnight camping. The Reading Island Recreation Site is open to the general public between the hours of 5:00 a.m. and 11:00 p.m. Pacific Standard Time. After those hours, visitors to the site must obtain written authorization from a BLM authorized officer. Written authorization will be in the form of a Special Recreation Use Permit or equivalent instrument as determined by the BLM authorized officer. Law enforcement personnel and other public servants specifically authorized by the BLM are exempt from this closure. The authority for these closures and rule makings is 43 CFR 8365.1- 6. Any person who fails to comply with a supplemental rule is subject to arrest and fines of up to $100.000 and/or imprisonment not to exceed 12 months. Unauthorized vehicles left at the Reading Island Recreation Site while it is closed will be subject to towing at the owners expense. DATES: This supplementary rule will take effect November 6, 1998.
