(``the Act''), Agreement to establish a common computer tape storage specification has filed written notifications simultaneously with the Attorney General and the Federal Trade Commission disclosing (1) the identities of the parties and (2) the nature and objectives of the venture. The notifications were filed for the purpose of invoking the Act's provisions limiting the recovery of antitrust plaintiffs to actual damages under specified circumstances. Pursuant to Section 6(b) of the Act, the identities of the parties are Hewlett-Packard Company (``HP''), Palo Alto, CA; International Business Machines Corporation (``IBM''), Armonk, NY; Seagate Technology, Inc. (``SEAGATE''), Scotts Valley, CA. The nature and objectives of the venture are to develop, produce and establish a common computer tape storage specification; to combine and integrate into this specification complementary intellectual property of each of the parties; to develop an appropriate third-party mechanism for licensing such intellectual property as part of a license to use the specification to all interested parties under terms and conditions conducive to establishing an open, widely followed industry specification; to promote the development, production and sale of next- generation computer tape storage products compatible with this specification, thereby providing enhanced functionality afforded through the use of licensed intellectual property; and, through all of the foregoing, to enhance demand for next-generation computer tape storage products as alternatives to competing storage technologies.
