CHICAGO MANUFACTURER SETTLES ANTIBOYCOTT CHARGE

WASHINGTON -- The Commerce Department's Assistant Secretary for Export Enforcement, F. Amanda DeBusk, announced today that FMC Corporation, a Chicago, Illinois manufacturer and exporter, agreed to pay a $13,000 civil penalty to settle allegations by the Department=s Office of Antiboycott Compliance that FMC committed ten violations of the antiboycott provisions of the Ex Administrulations.

The Office of Antiboycott Compliance alleged that in a 1994 transaction with Kuwait, FMC furnished information about other persons' business relationships with or in a boycotted country when it provided a certificate that the goods supplied were not of Israeli origin and did not contain materials from Israel. FMC also allegedly furnished information about the ownership and blacklist status of the carrying vessel. Additionally, the OAC alleged that, in seven transactions between October 1993 and February 1994, FMC failed to report its receipt of requests to engage in restrictive trade practices or boycotts, ired bylations.

While neither admitting nor denying the allegations, FMC agreed to pay the civil penalty. FMC voluntarily disclosed the transactions that led to the allegations. FMC fuperated with the Department=s invn.

The antiboycott provisions prohibit U.S. companies and individuals from complying with certain aspects of unsanctioned foreign boycotts against any country friendly to the United States that is not itself the object of any U.S. boycott. Through its Office of Antiboycott Compliance, the Commerce Department investigates alleged violations, provides support in administrative or criminal litigation of cases, and prepares cases, and prepares cases for settlement.
