WASHINGTON -- The Commerce Department today imposed a $10,000 civil penalty
on Marc A. Leveille to settle allegations that he falsified or concealed a
material fact during an action initiated under the authority of the Export
Administration Act, Commerce Assistant Secretary for Export Enforcement, F.
Amanda DeBusk announced.
The action by Commerce's Bureau of Export Administration (BXA) related to
the export of aircraft parts, including aircraft seats, to France for installation
on aircraft belonging to Iran Air.
Earlier this year, as the result of a Commerce Department investigation, BE Aerospace, the U.S. company that manufactured the aircraft seats, pleaded guilty to a charge that it violated U.S. export controls and was sentenced to a $2,500,000 criminal fine and PTC Aerospace, a division of BE Aerospace, received a $500,000 civil penalty. While neither denying or admitting the allegations, Leveille, a French national and manager of BE Aerospace S.A. in Paris, agreed to pay the civil penalty to settle the allegations against him.
The Department of Commerce, through its Bureau of Export Administration, administers and enforces export controls for reasons of national security, foreign policy, nonproliferation and short supply. Criminal penalties, as well as administrative sanctions, can be imposed for violations of the regulations.
In April of 2002 the Bureau of Export Administration (BXA) changed its name to the Bureau of Industry and Security(BIS). For historical purposes we have not changed the references to BXA in the legacy documents found in the Archived Press and Public Information.
