The Type of Reporting Required chart contains a series of questions for an exporter to determine whether post-export report is required under the Wassenaar Arrangement. The proceeding is the list of questions with corresponding answers to reporting flowchart decision tree.

The first question is, "Am I exporting an National Security (NS) controlled item under the authority of a license exception?" If the item is not controlled for NS reasons, then there are no reporting requirements for Wassenaar.

If the item is controlled for NS reasons, you would proceed to the next question, which is, "Is my item classified under an Export Control Classification Number (ECCN) listed in ยง743.1(c)(1) of the Export Administration Regulations (EAR)? (See Attachment A for more information)." If the item is not classified under one or more of these ECCNs, then there are no reporting requirements for Wassenaar.

However, if the item is classified under one or more of these ECCNs, then you should proceed to the next question that asks, "Am I exporting to a non-Wassenaar member country? (See Attachment B for the list of member countries)." If the item is being exported to a Wassenaar member country, then there are no reporting requirements for Wassenaar.

If you are exporting to a non-member country, then you proceed to the next question, which is "Am I exporting under License Exception CTP?" If you are then you should proceed to the next question, which asks, "Am I exporting a computer under ECCN 4A003.b or 4A003.c with a Composite Theoretical Performance (CTP) greater than or equal to 28,00 Million Theoretical Operations Per Second (MTOPS)?"

If you are using License Exception CTP to export a computer under ECCN 4A003.b or 4A003.c with a CTP greater than or equal to 28,000 MTOPS, reporting requirements under Wassenaar apply. You must report the ECCN and paragraph reference, the number of units shipped, the country of ultimate destination and the CTP of the computer.

If you are not using License Exception CTP to export your item, then the next question is "Are you using License Exception TSR?" If you are using this license exception, then refer to Attachment C for special instructions on how to report. If you are not using License Exceptions CTP or TSR, and are rather exporting under License Exception LVS, GBS, CIV or GOV, then reporting requirements apply. You must report the ECCN and paragraph reference of the item, the number of unites shipped and the country of ultimate destination
