7/27/92 U.S. v. Phillip Dennis Holder
Criminal No.: CR-92-186-01-G (M.D.N.C.)

One-count information was filed in U.S. District Court in Greensboro, North Carolina, charging Phillip Dennis Holder, former regional manager of Pet Incorporated, and its successor, Land-O-Sun Dairies, Inc., with rigging bids, in violation of Section 1 of the Sherman Act, submitted to certain school boards in the state of North Carolina for the award and performance of contracts to supply dairy products to public schools in various school districts in North Carolina, beginning at least as early as 1982 and continuing thereafter at least through June 1989.

7/27/92 U.S. v. Hugh P. Bowman, Joe C. McMillan, and Paul W. Tucker
Criminal No.: CR-92-187-01-G (M.D.N.C.)

Five-count indictment was filed in U.S. District Court in Greensboro, North Carolina, charging Hugh P. Bowman, Joe C. McMillan and Paul W. Tucker with one count of bid rigging (15 U.S.C. § 1) and four counts of mail fraud (18 U.S.C. § 1341) involving contracts to supply milk and dairy products to designated schools in North Carolina, beginning as early as the spring of 1982 until the end of the 1987-88 school year. Messrs. Bowman and McMillan are managers for Flav-O-Rich, Inc. which is headquartered in Louisville, Kentucky. Mr. Tucker was formerly a manager with Land-O-Sun, Inc. which is headquartered in Johnson City, Tennessee.

7/30/92 U.S. v. Samuel Hinote
Criminal No.: 92-00430 (E.D. Pa.)

One-count indictment was filed in U.S. District Court in Philadelphia, Pennsylvania, charging Samuel Hinote, former president of Delta Pride Catfish, Inc. of Indianola, Mississippi, with fixing the price, in violation of Section 1 of the Sherman Act, of catfish products sold nationwide, beginning at least as early as 1981 and continuing thereafter to at least as late as 1990.
