of Justice Issues Business Review Letter
In a letter from John
W. Clark, Acting Assistant Attorney General in charge of the Antitrust
Division, to B. Lawrence Theis, counsel for the Colorado Asphalt
Producers Association ("CAPA"), the Department advised that it
does not intend to challenge the proposal by CAPA to initiate
an asphalt industry advancement program ("AIAP") to engage in
the research and development of a better asphalt product and to
promote the advantages of asphalt cement over concrete. CAPA is
a non-profit industry association comprised of 65 members which
are engaged in the production of asphalt cement and in the construction
of roads and highways, using asphalt cement, in the state of Colorado.
Beginning sometime in 1993 and extending over a five-year period,
CAPA plans to initiate a new assessment methodology to collect
a higher assessment from its members to fund the AIAP. Participation
in the program is open to non-members of CAPA and is voluntary
for CAPA members.

Two one-count informations
were filed in U.S. District Court in Detroit, Michigan, charging
Bareman Dairy, Inc. of Holland, Michigan and McDonald Dairy Company
of Flint, Michigan, with rigging bids, in violation of Section
1 of the Sherman Act, for contracts to supply milk and other dairy
products to certain schools and school districts in certain counties
in western Michigan. The informations charged that the conspiracy
began as early as the 1986-87 school year and continued until
the 1989-90 school year.
