The FMCSA FOIA Staff welcomes you to our FOIA site. The purpose of this site is to provide the public with information about requesting records from the FMCSA under the FOIA. The FOIA is a Federal statute that gives any person the right to request records from Federal agencies.

The Freedom of Information Act (5 U.S.C. 552) establishes a presumption that records in the possession of agencies and departments of the Executive Branch of the U.S. Government are available to the public. The FOIA sets standards for determining when Government records must be made available and which records may be withheld. The FOIA also gives requesters specific legal rights and provides administrative and judicial remedies when access to records or portions of records is denied. Most importantly, the FOIA statute requires that Federal agencies provide access to and disclosure of information pertaining to the Government's business to the fullest extent possible. The text of the Act may be viewed by accessing the U.S. Department of Justice FOIA Web site. The FMCSA strongly endorses a policy of openness in Government.

If you are seeking general information about FMCSA, please visit FMCSA's home page and/or the Department of Transportation's (DOT) home page to find information which is publicly available without submitting a FOIA request.

Before you submit a FOIA request for FMCSA documents (FOIA provides only for the release of documents; it doesn't answer questions), please be aware of the following:

  • You must make your request in writing and include your name, address, and a telephone number where we can reach you if we have questions about your request.
  • You should clearly indicate that you are making your request under FOIA.
  • The request must reasonably and specifically describe the documents you seek. (When requesting documents on a specific motor carrier, please include the motor carrier name and principal place of business or Department of Transportation number if available).
  • You may submit your request using one of the three following methods:
