President's Export Council Charter

CHARTER OF THE
PRESIDENT'S EXPORT COUNCIL

ESTABLISHMENT

The President's Export Council (PEC), established on December 20, 1973, by Executive Order No. 11753, is renewed by Executive Order 13446 of September 28, 2007, for the two-year period beginning October 1, 2007 and ending September 30, 2009.

OBJECTIVES AND DUTIES

1. Through the Secretary of Commerce (the "Secretary"), the PEC shall advise the President on matters relating to U.S. export trade and report to the President on its activities, and on its recommendations for expanding U.S. exports. The PEC shall function in an advisory capacity and in accordance with the provisions of the Federal Advisory Committee Act.

2. The Council should survey and evaluate the export expansion activities of the communities represented by membership; identify and examine specific problems that business, industrial, agricultural and government practices may cause for export trade; examine the needs of business, industry, and agriculture to expand their efforts; and recommend specific solutions to these problems and needs.

3. The PEC may act as liaison among the communities represented by the membership, and may provide a forum for those communities on current and emerging problems and issues in the field of export expansion.

4. The Council should encourage the business, industrial, and agricultural communities to enter new foreign markets and to expand existing export programs.

5. The Council shall provide advice on Federal plans and actions that affect export expansion policies that have an impact on those communities represented by the membership.

6. The PEC may establish, with the concurrence of the Secretary, an executive committee and such other subordinate committees as it considers necessary for the performance of its functions. The Chairman of each subordinate committee shall be designated, with the concurrence of the Secretary of Commerce, by the Chairman of the PEC from among the members of the PEC. Any proposed subordinate committee which is to contain one or more members who are not on the PEC will be separately chartered. Members of the subordinate committees shall be appointed by the Secretary of Commerce. One or more Vice Chairmen of each subordinate committee may be designated by the PEC Chairman with the concurrence of the Chairman of the subordinate committee.

MEMBERS AND CHAIRPERSONS

1. The PEC consists of the heads or their representatives of the Departments of Agriculture, Commerce, Energy, Labor, State, Treasury, Homeland Security, Office of the U.S. Trade Representative, the Small Business Administration, and the Export-Import Bank of the United States.

2. The PEC consists of five members of the United States Senate designated by the President of the Senate to serve a two-year term; and five members of the United States House of Representatives designated by the Speaker of the House to serve a two-year term.

3. The PEC also consists of not more than 28 citizens appointed by the President from representatives of business and industry, agriculture, and labor who are not full-time Federal officers or employees. Members will be selected on a clear, standardized basis, in accordance with applicable Department of Commerce guidance.

4. The President shall designate a Chairman and Vice Chairman from among the members appointed by the President.

ADMINISTRATIVE PROVISIONS

1. As permitted by law and as necessary to carry out the purposes of Executive Order 13225, the International Trade Administration shall provide administrative and staff services, support, and facilities for the PEC. The International Trade Administration may seek agreement from other government units to provide such services, support, and facilities for subordinate committees.

2. Each member of the PEC, including its Executive and subordinate committees, who is not otherwise paid a salary by the Federal Government, shall receive no compensation from the United States by virtue of his service on the Council, but members, upon their request, may be allowed travel expenses, as authorized by 5 USC 5701 et seq.

3. With the concurrence of the Chairman, the Under Secretary for International Trade shall serve as the Executive Director of the Council.

4. An Executive Secretary, responsible for coordinating administrative and staff support for the Council and its subordinate subcommittees, shall be designated by the Under Secretary for International Trade from among the employees of the International Trade Administration.

5. The PEC will meet semi-annually; however, additional meetings may be called at the discretion of the Department of Commerce with the concurrence of the Chairman. Meeting dates and meeting agendas of the full committee shall be approved by the Executive Secretary on behalf of the Secretary with the concurrence of the Chairman. Meeting dates and meeting agendas of the subordinate committees shall be approved by the Executive Secretary on behalf of the Secretary with the concurrence of the Chairman of the subordinate committee.

6. PEC members shall have the appropriate security clearance required to handle or receive any security classified information up to the secret level.

7. The estimated annual operating cost of the PEC is $223,626.00, which includes 2.67 person years of staff support.

DURATION

As provided by the Federal Advisory Committee Act (5 USC App. 2) and Executive Order 13316, the PEC shall terminate on September 30, 2005, unless it is terminated earlier or renewed by proper authority by appropriate action.
