FACT SHEET Final Determinations in Antidumping and Countervailing Duty Investigations: Carbazole Violet Pigment-23 from India and the People's Republic of China On November 9, the Department of Commerce (the Department) announced the final determinations for the above-referenced investigations. We found that producers/exporters of Carbazole Violet Pigment-23 (CVP-23) from India and the People's Republic of China (PRC), sold their products in the United States at less than fair value, with margins ranging from 27.23 to 69.23 percent for India, and 5.51 to 217.94 percent for the PRC. In addition, the Department found that countervailable subsidies exist with regard to exports from India with net subsidy rates ranging from 17.33 to 33.61 percent. Next Steps: The United States International Trade Commission (ITC) is scheduled to announce its final injury determinations in the India and PRC investigations on or before December 23. If the ITC affirmatively determines that imports of CVP-23 are materially injuring, or threatening material injury to, the domestic industry, then the Department will issue antidumping and countervailing duty orders in January 2005. If the ITC makes negative injury determinations, the investigations will be terminated and no orders will be issued. Petitioners: The petitions requesting these investigations were filed on November 21, 2003, by Sun Chemical Corporation (Cincinnati, Ohio) and Nation Ford Chemical Company (Fort Mill, South Carolina ), domestic producers of CVP-23. Product Description: The merchandise covered by these investigations is carbazole violet pigment 23 (CVP-23) identified as Color Index No. 51319 and Chemical Abstract No. 6358-30-1, with the chemical name of diindolo [3,2-b:3',2'-m]triphenodioxazine, 8,18-dichloro-5, 15-diethy-5, 15-dihydro-, and molecular formula of C34H22Cl2N4O2.1 The subject merchandise includes the crude pigment in any form ( e.g., dry powder, paste, wet cake) and finished pigment in the form of presscake and dry color. CVP-23 in its crude pigment form is used exclusively as an input for the production of CVP-23 presscake and dry color. Presscake and dry color are used as coloring agents in the production of paints and coatings, plastics, printing inks and to produce pigment dispersions in oleoresins, flammable solvents, water or other vehicles. Pigment dispersions in any form ( e.g., pigments dispersed in oleoresins, flammable solvents, water) are not included within the scope of the investigations. The merchandise subject to these investigations is classifiable under subheading 3204.17.9040 of the Harmonized Tariff Schedule of the United States (HTSUS). Although the HTSUS subheadings are provided for convenience and customs purposes, the written description of the merchandise under investigation is dispositive. Final Dumping Margins:
