Initiation of Antidumping and Countervailing Duty Investigations of

Live Swine from Canada

On April 8, the Department of Commerce announced its decision to initiate antidumping (AD) and countervailing duty (CVD) investigations on imports of live swine from Canada.   On May 3, the U.S. International Trade Commission (ITC) is scheduled to issue its preliminary injury determination.   If the ITC finds that there is a reasonable indication that imports of live swine from Canada are causing material injury, or threatening to cause material injury, to a U.S. industry, the Department will be scheduled to issue its preliminary CVD determination on June 11, and its preliminary AD determination on August 25.

Petitioners:   On March 5, U.S. producers of live swine filed petitions with the Department of Commerce requesting the initiation of AD and CVD investigations.   The petitions were filed by the Illinois Pork Producers Association, the Indiana Pork Advocacy Coalition, the Iowa Pork Producers Association, the Minnesota Pork Producers Association, the Missouri Pork Association, the Nebraska Pork Producers Association, Inc., the North Carolina Pork Council, Inc., the Ohio Pork Producers Council, and 119 individual producers of live swine.

Product Description:  The products covered by these investigations are all live swine from Canada, except U.S. Department of Agriculture-certified purebred breeding swine.   This merchandise is currently classifiable under Harmonized Tariff Schedule of the United States (HTSUS) subheadings 0103.91.0010, 0103.91.0020, 0103.91.0030, 0103.92.0010, 0103.92.0090.   ( Prior to June 30, 2003, HTSUS subheadings 0103.91.0010, 0103.91.0020, and 0103.91.0030 were all included under one subheading, HTSUS 0103.91.0000.)
