2093. EMERGENCY EVACUATION; EMERGENCY TEMPORARY STANDARD

Abstract: The Mine Safety and Health Administration (MSHA) issued an Emergency Temporary Standard (ETS) under the Federal Mine Safety and Health Act of 1977 (Mine Act), section 101(b) in response to the grave danger that underground coal miners are exposed to during mine fires, explosions, and gas or water inundation emergencies. The deaths of 14 miners at two underground coal mines demonstrated the need for MSHA to address proper training and mine emergency evacuation procedures. Under the Mine Act, the ETS, which became effective on December 12, 2002, acts as a proposed rule. MSHA conducted public hearings and accepted written comments on the proposed rule. The Mine Act requires that the Secretary promulgate a final rule no later than 9 months after publication of the ETS as provided for under section 101(b) of the Mine Act.
