Office of Hazardous Materials Enforcement
Mission:
To plan and manage the national program of safety inspection and
enforcement of the hazardous materials regulations.
The functions of this Office are:

Advise the Associate Administrator for Hazardous Materials
Safety on policy development and program requirements for the
national program of safety inspection and enforcement of hazmat
regulations;

Conduct inspections and investigations to determine compliance
with the Hazardous Materials Transportation Act (49 U.S.C. 1801
et seq.) and the hazardous materials regulations contained in
Title 49, Code of Federal Regulations, Parts 100-178, (including
special permitss and approvals issued thereunder);

Prepare reports and evidence and recommend enforcement actions
to the PHMSA Chief Counsel; assisting the Chief Counsel in the
preparation of civil and criminal enforcement actions; and provide
technical expertise in administrative and judicial proceedings;

Maintain liaison with other Operating Administrations in the
Department, Federal agencies, and State enforcement organizations
concerning hazmat transportation inspection and enforcement; and

Advise the Office of Hazardous Materials Standards regarding
the enforceability of existing and proposed regulations.
The functions of this Office are also subject to the executive
direction of the Associate Administrator for Hazardous Materials
Safety.
