WALKER RIVER PAIUTE TRIBE,

                                                                                                   Appellant,

v.

DEPARTMENT OF THE INTERIOR,

                                                                                                   Respondent.

Genia Williams, Chairman of Walker River Paiute Tribe, Schurz, NV, appearing for Appellant.

Sabrina A. McCarthy, Office of the Solicitor, Department of the Interior, Washington, DC, counsel for Respondent.

DANIELS, Board Judge (Chairman).

ORDER

On March 7, 2007, the Walker River Paiute Tribe (the Tribe) appealed from a February 28, 2007, decision of an Indian Self Determination Specialist of the Department of the Interior’s Bureau of Indian Affairs. An audit had concluded that “[d]uring tests of expenditures charged to the major programs, support documentation could not be located by the Tribe” for eight expenditures totaling $6193. The Indian Self Determination Specialist disallowed the Bureau’s portion of costs in this amount and stated that a bill for collection would be issued in ninety days if payment was not received.

On June 4, 2007, the Department of the Interior forwarded to us a motion to dismiss the case which had been sent by the Tribe to the Board, but at the Department’s address. According to the motion, the Tribe does not wish to pursue the case because the Indian Self Determination Specialist has determined that the Tribe has provided proper documentation as to the $6193 in dispute and has allowed these costs. The Department has no objection to our dismissal of the case.

Accordingly, the case is DISMISSED WITH PREJUDICE.
