Adoption Status of National MUTCD by States and Federal Agencies

The 2003 Manual on Uniform Traffic Control Devices (MUTCD) Edition was published on November 20, 2003. The adopted changes were effective on December 22, 2003. 23 CFR provides the States with a 2-year period from the effective date to adopt the MUTCD. Therefore, by December 22, 2005 States were required to have adopted the National Manual or have a State MUTCD/supplement that is in substantial conformance with the National Manual. The role of our FHWA Division Offices is to review and approve any State MUTCD or supplement that is in substantial conformance with the National MUTCD. (23CFR 655.603(b). This list includes Puerto Rico and Washington D.C. as States.

It was adopted by KAR 6:050; 603 KAR 5:050. Uniform traffic control devices. RELATES TO: KRS 189.337; STATUTORY AUTHORITY: KRS 189.337(2), 23 C.F.R. Part 655 Subpart F NECESSITY, FUNCTION, AND CONFORMITY: KRS 189.337(2) requires the Transportation Cabinet, Department of Highways, to promulgate and adopt a uniform system of traffic control devices. The Federal Highway Administration through its regulation 23 C.F.R. Part 655 requires that the traffic control devices on all public highways or streets be in substantial conformance with the "Manual on Uniform Traffic Control Devices". This administrative regulation defines the system by incorporating by reference the "Manual on Uniform Traffic Control Devices" and the amendments adopted to the manual.

Section 1. Traffic Control Devices on All Public Highways. The standards and specifications set forth in the Federal Highway Administration publication "Manual on Uniform Traffic Control Devices for Streets and Highways" shall apply to all traffic control devices, including signs and roadway markings, installed on any publicly used highway, road, street, avenue, alley, boulevard, bridge, viaduct, or trestle, and the approaches to them, and off-street parking facilities in Kentucky. The revised state regulation pertaining to Title 41 1, Chapter 1 of the Nebraska Administrative Code, Rules and Regulations of the Nebraska Department of Roads, Traffic Engineering Division - Manual on Uniform Control Devices, 2003 Edition was filed with the Secretary of State on December 6,2005, following adoption by the Director and approval by the Attorney General and the Governor. The revised regulation became effective December 11, 2005. It specifies that Nebraska has adopted (1) the MUTCD 2003 Edition dated November 20,2003 and (2) the Nebraska Supplement to the Manual of Uniform Traffic Control Devices, 2004. A June 6, 2005 review of the Supplement by FHWA Division Office found it to be in substantial conformance with National MUTCD and so documented in a 12/14/05 letter...

Adopted in accordance with the State Transportation Commission Resolution No. 2003-5(July). Only modification is to Section 5A.01 Standard B: Removed the wording that disallows a road on designated state highway system from qualifying as a low volume road. The exception is required due to the many miles of low-volume unpaved roads designated as State Highways. Disallowing a state highway from qualifying as a low-volume road would put a significant burden on our state to sign numerous miles of unpaved, dirt roads to the same standards as our other roadways.
New York (NY)

The current New York State (NYS) 2001 MUTCD was made effective by NYS Department of State on 4/11/2001. Their action also rescinded the 1983 NYS MUTCD. This NYS manual update was under development for some time and was intended to bring it in conformance with the then current National 1988/1993 MUTCD. This NYS MUTCD is expected to undergo further revisions to further conform to the national 2000 MUTCD.

Ohio law is interpreted to require its own State manual. The Ohio MUTCD is basically the same as the federal MUTCD, but with a limited number of additions and deletions to fit Ohio preferences or legal requirements. It is a separate, independent document that ODOT has created and published. It was based on the electronic version of the federal MUTCD that was physically edited to add or remove particular text. It also has edited figures to look like Ohio situations.

The MUTCD 2003 was adopted by the PRDOT by reference from State Law #22 - Transportation Law. Law #22 specifies that any federal Uniform Traffic Control Device national standard will be the Puerto Rico standard for traffic control devices. Consequently, the MUTCD 2003 is the standard for Puerto Rico.
Rhode Island (RI)

Tennessee has adopted the manual as of Sept. 25, 2004. Tennessee's supplement to the MUTCD, "Rules for Guide Signs on Freeways, Expressways and Conventional Highways", was adopted July, 2005. The FHWA Tennessee Division Office, via letter, dated December 7, 2004, determined that Tennessee's supplement was in substantial conformance with the National MUTCD. Any revisions after September 25, 2004 must be sent through a state approval process each time to be considered adopted. TDOT can no longer automatically adopt the revisions as had been done previously.
