AGREEMENT RENEWING AN ALLIANCE
BETWEEN THE
OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION,
MINE SAFETY AND HEALTH ADMINISTRATION,
OFFICE OF THE ASSISTANT SECRETARY FOR POLICY'S WORKING PARTNERS FOR AN ALCOHOL- AND DRUG-FREE WORKPLACE PROGRAM

ASSOCIATED GENERAL CONTRACTORS OF AMERICA,

INTERNATIONAL ASSOCIATION OF HEAT AND FROST INSULATORS AND ASBESTOS WORKERS,

INTERNATIONAL UNION OF OPERATING ENGINEERS,

UNITED BROTHERHOOD OF CARPENTERS AND JOINERS OF AMERICA

The U.S Department of Labor's Occupational Safety and Health Administration (OSHA), Mine Safety and Health Administration (MSHA) and the Office of the Assistant Secretary for Policy's Working Partners for an Alcohol- and Drug-free Workplace Program (Working Partners) join with American Road & Transportation Builders Association (ARTBA), Associated General Contractors of America (AGC), International Association of Bridge, Structural Ornamental and Reinforcing Ironworkers (IABSORIW), International Association of Heat and Frost Insulators and Asbestos Workers (IAHFIAW), International Brotherhood of Boilermakers (IBB), International Union of Operating Engineers (IUOE), International Union of Painters and Allied Trades (IUPAT), Laborers' International Union of North America (LIUNA), National Asphalt Pavement Association (NAPA), NEA – The Association of Union Constructors (NEA), Specialized Carriers & Rigging Association (SC&RA), United Association of Journeymen and Apprentices of the Plumbing and Pipe Fitting Industry of the United States and Canada (UAJAPPFI) and the United Brotherhood of Carpenters and Joiners of America (UBCJA) to hereby renew the Alliance signed October 12, 2004. Through the Alliance, the organizations will continue to recognize the value of continuing a collaborative relationship to foster safer, drug-free and more healthful American workplaces and protect employees' health and safety. OSHA, MSHA and Working Partners and ARTBA, AGC, IABSORIW,I AHFIAW, IBB, IUOE, IUPAT, LIUNA, NAPA, NEA, SC&RA, UAJAPPFI and UBCJA agree to use their collective expertise to help provide the organizations' members and the construction industry with information, guidance, and access to training resources that will help them understand the benefits of drug-free workplace programs and protect employees' health and safety. The organizations will particularly focus on educating workers on safety and productivity hazards created by the abuse of alcohol and drugs in the workplace. In renewing this Alliance, OSHA, MSHA and Working Partners and ARTBA, AGC, , IABSORIW, IAHFIAW, IBB, IUOE, IUPAT, LIUNA, NAPA, NEA, SC&RA, UAJAPPFI and UBCJA recognize that OSHA's State Plan and Onsite Consultation Project partners are an integral part of the OSHA national effort.

Alliances with the Department of Labor provide parties an opportunity to participate in a voluntary cooperative relationship with the Department for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both the Department and its Alliance participants. By entering into an Alliance with a party, OSHA, MSHA and Working Partners are not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services. This Alliance does not obligate any part to take any action or expend any funds, nor does it limit any party's right to take any other action it deems necessary.

An implementation team made up of representatives of all of the organizations will meet to develop a revised plan of action, update working procedures, and redefine the roles and responsibilities of the participants. In addition, the team will continue to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. Team members will include representatives of OSHA's Directorate of Cooperative and State Programs, Directorate of Science, Technology and Medicine, Directorate of Construction, and any other appropriate offices. OSHA will encourage State Plan States' and OSHA Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Any signatory may terminate its own participation for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all signatories.
