Criminal history records

A criminal history record describes any arrests and subsequent dispositions attributable to an individual. Complete, accurate, and immediately accessible records enable states to:

  • immediately identify individuals with prior criminal records in any state
  • more effectively identify felons and others prohibited from firearm purchases
  • check backgrounds of persons responsible for child, elder and disabled care
  • identify individuals who have a history of domestic violence or stalking
  • make informed decisions relating to pretrial release and detention of offenders, prosecutions of career criminals and appropriate correctional confinement
  • conduct background checks to protect public safety and national security

Criminal records are maintained by each state in a central repository. To facilitate the interstate exchange of criminal history records, the FBI maintains the Interstate Identification Index (III) which is an “index-pointer” system to records of persons arrested for felonies or serious misdemeanors under state or federal law.

On December 31, 2003 —

  • Over 71 million criminal history records were in the criminal history files of the state criminal history repositories. (An individual offender may have records in several states.)

  • Ninety-four percent of the criminal history records maintained by the state criminal history repositories were automated. Approximately 4.1 million records, or 5.7%, were not automated.

  • All of the reporting states, Puerto Rico and the District of Columbia had automated at least some records in either the criminal history record file or the master name index.

Background checks for firearm transfers

Federal law prohibits firearm possession by or transfer to prohibited persons including those who are under indictment for or convicted of a crime punishable by imprisonment for more than 1 year.

  • In 2007 over 8.6 million applications for firearm transfers or permits were subject to background checks under the Brady Act and similar state laws.
  • From the inception of the Brady Act in March 1994 through December 2007, more than 87 million applications for firearm transfers were subject to background checks. About 1,631,000 applications were rejected.
  • Among state checking agencies in 2007, 39% of all rejections for firearm transfers were due to a felony conviction.
  • Among all agencies conducting background checks, 64% of applications were denied due to reasons other than a felony conviction in 2007.

Sex offender registries (SOR)

As of April 2008 —
  • All 50 states and the District of Columbia had centralized sex offender registries.
  • 50 states, the District of Columbia, and Guam, Puerto Rico, and U.S. Virgin Islands were submitting records on sexual offenders to the National Sex Offender Registry.

About the data collections

Compendium of State Privacy and Security Legislation - references and classifies state legislation on privacy and security of state criminal history record information. Statutes are grouped into 29 categories and presented both by classification and by state. It is compiled every two years.
1974, 1978, 1979, 1981, 1984, 1987, 1989, 1992, 1994, 1997, 1999 and 2002

Firearm Inquiry Statistics (FIST) Program - is designed to collect annual data describing the number of inquiries made in connection with presale handgun checks and the number and basis for rejection of such inquiries. Data are collected directly from state agencies conducting background checks and from local checking agencies and include the number of firearm applications made to the agency, firearm applications rejected by the agency, and the reasons for rejection. Data collection procedures are adjusted to reflect the differing presale check procedures under the permanent system (which became effective on 11/30/98) and the interim period (02/28/94 - 11/29/98).
Annually since 1994.

National Instant Background Check (NIC) Survey - collects data from the states to identify major impediments to disposition completeness, with a primary focus on the linkage between criminal records repositories and the courts and prosecutors. The survey seeks information on:

  • procedures for transmission of arrest and disposition data from law enforcement agencies, prosecutors, and the courts to the repository
  • processes for integrating justice systems records in terms of disposition capture and linking of dispositions to arrest records
  • participation in national programs of the FBI such as the Interstate Identification Index (III) and the National Fingerprint File (NFF)
  • NICS and POCS inquiries and record accessibility
  • an analysis of the age of records and their completeness

Survey of State Criminal History Information Systems - collects data used as the basis for estimating the percentage of total state records that are immediately available through the FBI's Interstate Identification Index (III) and the percentage that include dispositions. Other data collected include the number of records maintained by each state, the percentage of automated records in the system, and the number of states participating in the FBI's Interstate Identification Index.

Survey of State Procedures Related to Firearm Sales - collects data about the state laws, regulations, procedures, and information systems related to sales and other transfers of firearms that were in effect as of June 30 of the collection year. These data were collected from hundreds of federal, state, and local agencies, including law enforcement organizations, statistical analysis centers, and legislative research bureaus.
