Federal Land Transaction Facilitation Act

The Federal Land Transaction Facilitation Act (FLTFA, also known as the “Baca Bill”) was enacted in July 2000 (P.L. 106-248).
 
The act allows a portion of the proceeds from BLM public land sales to be used to purchase certain qualified private properties. In addition to BLM, the U.S. Forest Service, the National Park Service, and the U.S. Fish and Wildlife Service can use a portion of those funds for land acquisitions.
 
FLTFA established the following requirements for such land purchases: 
  1. The lands to be acquired must be in the same state as the lands that were sold;
  2. The owner of the lands to be acquired must be a willing seller; and
  3. The lands to be acquired must be within or adjacent to a federally designated area and contain an exceptional resource.
The required processing steps and agreements are in place to start the acquisition phase of FLTFA. The four affected agencies can nominate lands for acquisition consideration at any time. The final land acquisition decisions will be made jointly by the Secretary of the Interior and the Secretary of Agriculture.
