Frequently Asked Questions (FAQs)

Question: If a state minimum wage law provides greater protection than the federal minimum wage, do I still have to post the federal Fair Labor Standards Act/Minimum Wage poster?

Answer:

Yes. If a state law provides greater protection (e.g., has a higher minimum wage than the federal minimum wage), the employer still has to post the federal Fair Labor Standards Act (FLSA) / Minimum Wage poster. (Note that the federal poster provides information regarding federal regulations on child labor and overtime rules in addition to the federal minimum wage.)
